1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “Student”, “Institution”) and www.testkaaro.com (“Company”, “Platform”, “we”, “us”), governing your access to and use of the TestKaaro web platform, including all related features, content, and services.
By registering, accessing, or using our Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you are accessing the Platform on behalf of an educational institution, you represent that you have the authority to bind that institution to these Terms.
If you do not agree to these Terms, you must not use the Platform.
2. Eligibility
- You must be at least 13 years of age to use the Platform. Users between 13 and 18 years require parental or guardian consent.
- You must have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
- Educational institutions must be duly registered entities under applicable Indian law.
- We reserve the right to refuse service to any person or entity at our sole discretion.
3. Account Registration and Security
To access Platform features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain and promptly update your account information to keep it accurate.
- Maintain the confidentiality of your password and account credentials.
- Accept responsibility for all activities occurring under your account.
- Immediately notify us at support@testkaaro.com of any unauthorized access to your account.
We are not liable for any loss or damage arising from your failure to comply with these obligations. We reserve the right to suspend or terminate accounts that provide false information or are used in violation of these Terms.
4. Description of Services
TestKaaro provides the following services:
- AI-powered evaluation of student handwritten answer sheets uploaded as images or PDF files.
- Detailed feedback, scoring, and performance analytics on descriptive answers.
- Comparison of student responses against model answers or evaluation rubrics.
- Progress tracking dashboards for students and educators.
- Subscription-based access plans for individuals and institutions.
Services are provided on an “as-is” and “as-available” basis. We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice.
5. Subscription Plans and Payments
5.1 Subscription Plans
We offer various subscription plans with different features and usage limits as described on our pricing page. Plan details, pricing, and features may change with prior notice.
5.2 Payment Terms
- All payments are processed in Indian Rupees (INR) via Razorpay Payment Gateway.
- Payment is due upfront for the selected subscription period.
- Subscriptions renew automatically unless cancelled before the renewal date.
- We accept UPI, credit/debit cards, net banking, EMI, and other payment methods supported by Razorpay.
- Prices are inclusive of applicable GST unless explicitly stated otherwise.
5.3 GST and Invoicing
We are registered under the Goods and Services Tax Act, 2017. GST at applicable rates will be levied on all payments. Valid GST invoices will be issued electronically to your registered email address within 48 hours of successful payment.
5.4 Failed Transactions
If a payment fails, your access may be suspended. We will notify you and provide a grace period of 3 days to retry payment. We are not responsible for charges imposed by your bank for failed transactions.
6. Refund and Cancellation Policy
6.1 Cancellation
You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the expiry of the paid period.
6.2 Refunds
Given the nature of digital educational services, our refund policy is as follows:
- No refunds are issued for partially used subscription periods.
- Refunds will be processed to the original payment method within 5–7 business days via Razorpay.
- Institutional subscriptions are governed by separate agreements and may have different refund terms.
To request a refund, email support@testkaaro.com with your transaction ID and reason for refund.
6.3 Consumer Protection
Nothing in this Refund Policy limits your rights under the Consumer Protection Act, 2019. If you have a grievance, you may also approach the National Consumer Disputes Redressal Commission (NCDRC) or applicable State Consumer Disputes Redressal Commission.
7. User Obligations and Acceptable Use
You agree to use the Platform only for lawful educational purposes. You must NOT:
- Upload content that does not belong to you or that you do not have rights to submit.
- Upload offensive, obscene, defamatory, or illegal content.
- Attempt to reverse-engineer, scrape, or exploit our AI evaluation systems.
- Share your account credentials with others (individual plans are non-transferable).
- Use automated tools, bots, or scripts to access the Platform without authorization.
- Violate any applicable Indian or international laws, including the IT Act, 2000, Copyright Act, 1957, or DPDPA, 2023.
- Attempt to gain unauthorized access to any part of the Platform or its infrastructure.
- Use the Platform to infringe upon the intellectual property rights of any third party.
Violation of these obligations may result in immediate account suspension or termination without refund.
8. Intellectual Property Rights
8.1 Our Content
All content on the Platform, including but not limited to AI algorithms, evaluation models, reports, text, graphics, logos, software, and user interfaces, is the exclusive property of TestKaaro or its licensors and is protected under the Copyright Act, 1957, and other applicable Indian intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
8.2 Your Content
You retain ownership of the content you upload (answer sheets, images). By uploading content, you grant us a limited, non-exclusive, royalty-free license to process, analyze, store, and display your content solely for the purpose of providing our services to you.
You represent and warrant that your uploaded content does not infringe upon any third-party intellectual property rights and is not unlawful.
8.3 Feedback
If you provide us with feedback or suggestions, you grant us an irrevocable, royalty-free license to use such feedback for improving our services without any obligation to you.
9. AI Evaluation Disclaimer
Our Platform uses artificial intelligence and machine learning models for answer evaluation. You acknowledge and agree that:
- AI evaluations are assistive tools and not a substitute for human expert assessment.
- AI results may occasionally contain errors or inconsistencies.
- Scores and feedback are indicative and should not be used as the sole basis for academic decisions.
- We do not guarantee 100% accuracy of AI-generated evaluations.
- We continuously work to improve our models, and results may vary across versions.
For high-stakes academic decisions, we recommend human expert review alongside our AI feedback.
10. Privacy
Your use of the Platform is governed by our Privacy Policy, incorporated herein by reference. By using the Platform, you consent to our data practices as described therein.
11. Third-Party Services and Links
The Platform integrates third-party services including Razorpay for payments, Google/Microsoft for authentication, and analytics providers. These third parties have their own terms and privacy policies that govern their services. We are not responsible for the practices of third-party services. Links to third-party websites are provided for convenience only and do not constitute endorsement.
12. Limitation of Liability
To the maximum extent permitted under Indian law, TestKaaro and its directors, employees, agents, and affiliates shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages.
- Loss of data, profits, revenue, or business opportunities.
- Damages resulting from unauthorized access to your account due to your own negligence.
- Errors or inaccuracies in AI-generated evaluation results.
- Interruption or unavailability of the Platform due to maintenance, technical failures, or force majeure events.
Our total aggregate liability for any claim arising out of these Terms shall not exceed the amount paid by you in the three months preceding the claim.
Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded under Indian law, including the Consumer Protection Act, 2019.
13. Indemnification
You agree to indemnify, defend, and hold harmless TestKaaro, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law; (d) your infringement of any third-party rights; or (e) content you upload to the Platform.
14. Disclaimer of Warranties
The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. Your use of the Platform is at your own risk.
15. Force Majeure
We shall not be held liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, government actions, internet disruptions, cyber-attacks, pandemics, natural disasters, or labor disputes.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.
16.2 Dispute Resolution
In case of any dispute, the parties shall first attempt amicable resolution through good-faith negotiation within 30 days of notice. If unresolved, disputes shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator mutually agreed upon by both parties. The seat and venue of arbitration shall be Delhi, India. Arbitration proceedings shall be conducted in English.
16.3 Consumer Disputes
Nothing herein limits your right to approach consumer forums under the Consumer Protection Act, 2019.
16.4 Jurisdiction for Courts
For matters not subject to arbitration, the courts of Delhi shall have exclusive jurisdiction.
17. Termination
17.1 Termination by You
You may terminate your account at any time by contacting us at support@testkaaro.com. Upon termination, your access to paid features will cease at the end of the current billing cycle.
17.2 Termination by Us
We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or pose a risk to the Platform or other users. We will notify you unless prohibited by law. Upon termination, your license to use the Platform ceases, and we may delete your data subject to our retention obligations.
18. Modifications to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 30 days in advance. Continued use after the effective date constitutes acceptance. If you do not agree to the revised Terms, you must discontinue use and may request account deletion.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy and any additional agreements you enter into with us, constitute the entire agreement between you and the Platform with respect to its subject matter and supersede all prior agreements, representations, and understandings.
